GENERAL CONDITIONS OF SALE FOR THE TEACHING AND SUPERVISION OF SKIING AND OTHER SLIDING DISCIPLINES OF THE INSTRUCTORS OF THE COURCHEVEL SKI CLUB SCHOOL.

Hereinafter referred to as "COURCHEVEL SKI CLUB” ski school. 

Via our website, by phone, by email or by any other means of remote communication you can now register for the services provided by the COURCHEVEL SKI CLUB prestations. For online sales via our site, simply follow the online registration procedures and your order will be sent to us electronically. 

For other distance selling methods, please contact COURCHEVEL SKI CLUB. 

The registration to COURCHEVEL SKI CLUB services implies the pure and simple acceptance of these general terms and conditions. 

 

ARTICLE 1 - COPYRIGHT 

This entire site is governed by French and international legislation on copyright and intellectual property. Any representation, reproduction, modification, commercial use, as well as any transfer to another site is prohibited, except with authorization to be requested by mail to the address indicated above. Only use for strictly personal purposes is permitted. 

 

ARTICLE 2 - SERVICES 

All COURCHEVEL SKI CLUB instructors have undergone training validated by the French State and hold a valid permit to teach skiing and its related disciplines. The teaching will be implemented according to the French Ski Method, codified by the Mémento de l'enseignement du Ski Français (published by the French Ministry of Sports), and recognized nationally and internationally. This teaching may take place in any environment and on any appropriate snow to enable the acquisition of the skills referred to in the Memento. 

Services are provided individually or in groups. The smooth running of the courses presupposes a homogeneity of the skiers' level. Given the material impossibility for COURCHEVEL SKI CLUB instructors to check the level of each student before registration, the latter is responsible for choosing the technical level he has selected according to the grid established by COURCHEVEL SKI CLUB. 

Consequently, COURCHEVEL SKI CLUB reserves the right to reincorporate in a group more adapted to its level a skier whose level does not correspond to its declaration and this subject to the capacities of the other groups. The skier will not be able to claim any refund or compensation as a result of this fact due to his sole declaration. 

The learning of skiing takes place in a specific environment with a random character. Its practice therefore requires the student to take personal care of his own safety and that of others. The instructor's liability is limited to an obligation of means. It is the student's responsibility to comply with the instructor's instructions. The student is solely responsible for his or her own equipment. 

COURCHEVEL SKI CLUB is not responsible for any accidents caused by skiers participating in the lesson. 

 

ARTICLE 3 - INSURANCE 

The service provider subscribes a Professional Civil Liability insurance which covers the instructors in the exercise of their function against damage to a third party as well as the practitioners during the time they are under the authority of COURCHEVEL SKI CLUB and the instructor. 

Customers and/or pupils shall be solely responsible for their own equipment. The instructors shall not be held responsible for any damage caused by this equipment or in the event of theft or damage to it. 

 

ARTICLE 4 - PRICES / REGISTRATION / PAYMENT 

4.1 : Prices 

The COURCHEVEL SKI CLUB prices are presented on the online sales site, accessible from courchevelskiclub.fr 

The prices indicated include the teaching service provided by an instructor, to the exclusion of any other service (insurance, ski lifts, accommodation, etc.), except in special cases. Consequently, the pupils must, before the scheduled time of the course, obtain a fixed price for access to the ski lifts and, at his or her choice, an insurance policy that will cover themselves against the risks inherent in practising sport in a mountain environment (civil liability, mountain rescue, etc.). 

4.2 : Registration and payment terms 

4.2.1: For online sales made via our site: 

You must complete the booking procedure on this site. With the online payment your reservation will be sent to COURCHEVEL SKI CLUB. You will immediately receive an e-mail acknowledgement of receipt of your order. 

Payment is full or 50% at the time of shipment of your reservation via 

The online sales site of the COURCHEVEL SKI CLUB school. This payment indicates the conclusion of the contract. This is confirmed by sending an email. 

A unique way to register and pay is available to you: Send your reservation and bank transfer via Internet to the COURCHEVEL SKI CLUB using the Regiondo reservation system and the Stripe payment platform. 

COURCHEVEL SKI CLUB ensures the only availability of the courses offered at the time of conclusion of the contract. 

4.2.2: For others modes of selling: 

Registration is done by sending a booking form with full payment, by cheque, credit card, etc., to COURCHEVEL SKI CLUB. 

COURCHEVEL SKI CLUB ensures the only availability of the courses offered at the time of the conclusion of the contract. 

Payment indicates the conclusion of the contract. 

 

ARTICLE 5 - NON-APPLICABLE RIGHT OF WITHDRAWAL WHATEVER THE BOOKING MODE 

The right of withdrawal within 14 days provided for in Article L221-18 of the Consumer Code does not apply to services offered for sale pursuant to Article L.221-28, in the case of leisure activity services which must be provided on a specific date. 

 

ARTICLE 6 - CANCELLATION OR INTERRUPTION BY THE CUSTOMER 

6.1 : Cancellation before the start of the service with partial payment: 

The partial payment constitutes a deposit that shallbe withheld by COURCHEVEL SKI CLUB in the case of the cancellation. 

6.2 : Cancellation before the start of the service with full payment: 

Case N°1 : Cancellation earlier than 15 days preceding the start of the service (15-30 days before) : 

If you have not taken out cancellation insurance and subject to the existence of a legitimate reason (inability to ski as evidenced by a medical certificate covering the period of the service) : the COURCHEVEL SKI CLUB school will propose the postponement of the service if possible and will otherwise refund all sums paid. 

In all others cases : the COURCHEVEL SKI CLUB shall refund you the price paid less the admisnistrative costs (10% of the transaction, with a minimum of 20 euros) and compensation for breach of contract (10% of the transaction, with a minimum of 20 euros) 

Case N°2 : Cancellation of a reservation before the 15 days preceding the start of the service (1-14 days before) : 

If you have not taken out cancellation insurance and subject to the existence of a legitimate reason (inability to ski as evidenced by a medical certificate covering the period of the service): the COURCHEVEL SKI CLUB school will propose the postponement of the service if possible and will otherwise refund all sums paid less the administrative costs (10% of the transaction with a minimum of 20 euros) 

In all other cases : the COURCHEVEL SKI CLUB school shall withhold 30% of the price paid. 

Case N°3: Cancellation less than 24 hours before the performance 

If you have not taken out cancellation insurance and subject to the existence of a legitimate reason (inability to ski as evidenced by a medical certificate covering the period of the service): the COURCHEVEL SKI CLUB school will propose the postponement of the service if possible and will otherwise refund all sums paid. 

In all other cases : the COURCHEVEL SKI CLUB school will apply a full deduction from the price of the day paid. 

Case N°4 : Interruption during the service 

In the absence of cancellation insurance and subject to the existence of a legitimate reason (inability to ski as evidenced by a medical certificate covering the period of the service): the COURCHEVEL SKI CLUB school will propose the postponement of the service if possible and will otherwise refund the unconsumed part in the form of a credit note calculated on the basis of the unit price.

ARTICLE 7 - CANCELLATION / INTERRUPTION / EXCLUSION DUE TO COURCHEVEL SKI CLUB 

7.1 : Cancellation/interruption 

COURCHEVEL SKI CLUB reserves the right to cancel or interrupt classes in the event of the closure of the slopes or ski lifts or if weather conditions make it dangerous for the group to enter the practice area. 

7.2 : Refund 

- In one of the cases mentioned in article 7.1: the COURCHEVEL SKI CLUB school will not refund the sums paid by the client in the event of cancellation of the service, and in the event of interruption will grant the client a credit note calculated on the basis of the unit price. 

- In all other cases: the COURCHEVEL SKI CLUB school will not refund the sums paid by the client in the event of cancellation of the service. 

7.3 : Exclusion 

The school of COURCHEVEL SKI CLUB reserves the right to exclude at any time a person whose behaviour is likely to disturb the progress and safety of the teaching. In this case, the customer will not be able to claim any refund. 

ARTICLE 8 - PROTECTION OF PERSONAL DATA 

As part of the services it offers, the COURCHEVEL SKI CLUB school collects personal data from its users. 

The collection of this data is subject to the provisions of the European General Data Protection Regulation of 25 May 2018 and the consolidated Law on Data Processing, Data Files and Individual Liberties of 6 January 1978. 

8.1 : Data collected & collection of consent 

The data collected during the voluntary registration of a user of the COURCHEVEL SKI CLUB school are: name, first name, postal address, e-mail address and telephone number. 

This information is strictly necessary for the execution of this contract agreed by the user. 

Photographs or videos can also be taken during courses and competitions. The consent of the pupils (or that of their legal representative for minor pupils) for the distribution of these images is collected via a form. 

8.2 : Purpose of the data processing 

These data are collected for the exercise of the activity of the COURCHEVEL SKI CLUB school only. 

The data collected may also be used for the purpose of promoting the COURCHEVEL SKI A LA FRANÇAISE brand under the express consent of the user. 

8.3 : Person responsible for the processing of personal data 

The COURCHEVEL SKI CLUB school is responsible for processing the personal data of users collected for the exercise of its activities. 

8.4 : Recipients of these data 

The data collected are intended for the management team of the COURCHEVEL SKI CLUB school. 

They are treated with the utmost confidentiality and are not communicated to any third party without obtaining the express consent of the user concerned. 

8.5 : Security of the processing operation 

The information collected is recorded in a computerized file of the COURCHEVEL SKI CLUB school. Appropriate technical and organisational measures shall be taken to prevent unauthorised access or disclosure of users' personal data. 

8.6 : Right of opposition, access, rectification and deletion 

Any client of the COURCHEVEL SKI CLUB school has the right to oppose, access, rectify and delete his personal data.

8.7 : Retention period 

The data collected are stored and archived by the COURCHEVEL SKI CLUB school. They will be anonymized after three consecutive seasons from the date of booking if the user does not respond to any request from the COURCHEVEL SKI CLUB school. 

 

ARTICLE 9 - HELMET USE 

Skiing is considered a high-risk sport. Helmets are mandatory for children under 13 years of age. And he is highly recommended for the other participants. 

The school of COURCHEVEL SKI CLUB also recommends the wearing of the ridge, as well as wrist and knee protectors when snowboarding. 

 

ARTICLE 10 – SPECIAL COVID-19 INFORMATION 

For all bookings that are cancelled on account of Sanitary crisis like COVID-19, all sums paid shall be carried over if this is possible otherwise be refunded (upon presentation of proof such as a medical certification or an institutional decision) 

If you are in the incapability to participate to your benefit. We will refund the total amount of the booking. Check below for further information : 

 

  • If the ski resort closes due to COVID 19. 

  • If the french gouvernement announces restriction for travelling and a mandatory quarantaine. 

  • If the french boarders are closed and you are in the impossibility to travel to the ski resort 

  • If your boarders are closed and you are in the impossibility to arrive or/and leave after the course 

 

If the service is curtailed on account of COVID-19, the sums paid shall be carried over, if this is possible, otherwise they shall be refunded on a “prorata temporis” basis, it’s mean in proportion to the hours and days performed. 

ARTICLE 11 - SETTLEMENT OF DISPUTES 

The parties shall endeavour to resolve amicably any difficulties that may arise in the performance of the contract. If no amicable agreement can be reached, all disputes relating to the validity, interpretation and execution of this agreement shall be governed exclusively by the rules of French law. 

All disputes, of any nature whatsoever 

will be subject to the jurisdiction of the French civil and commercial courts, including those ruling on summary proceedings. 

 

ARTICLE 12 - MEDIATION 

After having informed the management of the school of COURCHEVEL SKI CLUB and in the absence of a satisfactory response or in the absence of a response within 60 days, the customer may refer the matter to the Tourism and Travel Ombudsman.
